Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and [FILL IN: Dial.md operating entity — full legal name] (“Dial.md”, “we”, “us”), governing your access to and use of the Dial.md service at dial.md — including the API, the agent skill, prepaid credits, and calls placed through it (together, the “Service”). By registering an agent, claiming an account, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Dial.md is currently offered in limited preview, and access may be invitation-only. We may change or withdraw features during this period.
1. Who can use Dial.md
- You must be at least 18 and able to enter into a binding contract.
- The Service is intended for professional and business use. The person who claims an account and funds it (the “Supervisor”) is responsible for the AI agent operating under that account and for all activity on it.
- If you use Dial.md on behalf of an organization, you confirm you are authorized to bind it to these Terms.
2. Accounts and API keys
- An AI agent registers to obtain an API key; a human Supervisor claims the account by verifying an email address and funding it with credit.
- Your API key authenticates every request. Keep it secret. You are responsible for all calls placed and credit spent under your account.
- Because credit is prepaid, a leaked API key can spend only the credit already on the account — it can never charge a card or create debt. You remain responsible for securing the key.
3. What the Service does
- Dial.md places outbound telephone calls conducted by an automated AI voice on your behalf, toward a goal you define, and returns a transcript and a structured outcome.
- Calls are conducted by software. Outcomes are best-effort and are not guaranteed to be accurate, complete, or successful. Do not rely on a call outcome for any decision without verifying it yourself.
- Every call opens with a disclosure that the caller is an AI. You must not instruct the agent to conceal that it is an AI, to impersonate a specific real person, or to otherwise deceive the recipient.
4. Credits, pricing and payment
- The Service runs on prepaid credit, bought in packs through our payment processor, Stripe. Prices are shown at checkout in the stated currency and may exclude taxes, which are your responsibility.
- Each call places a hold on your credit and debits the actual cost when it ends. If your balance is insufficient, calls are declined.
- Credit is non-refundable, except where a refund is required by law, and unused credit expires 12 months after purchase.
- We may change prices and pack contents; changes apply only to purchases made after they take effect.
5. Acceptable use
You are responsible for the lawfulness of every call you initiate, including obtaining any consent the recipient’s jurisdiction requires and respecting permitted calling hours and do-not-call rules. You agree not to use Dial.md to:
- conduct telemarketing, robocalling, cold sales, or political, promotional, bulk, or unsolicited calling;
- harass, threaten, defraud, deceive, or impersonate a specific real person or organization;
- call emergency, premium-rate, or otherwise restricted numbers, or circumvent our region or number blocks;
- pursue anything illegal, or present the outcome of a call as authoritative professional advice (medical, legal, financial, or emergency);
- disable, overload, reverse-engineer, or gain unauthorized access to the Service.
We may block numbers, regions, or uses at our discretion to enforce this section or the law.
6. Your responsibilities
You represent that you have the right to contact the numbers you dial, that the objective and context you supply are lawful and accurate, and that your use complies with all applicable laws — including telecommunications, consumer-protection, and data-protection law. Where a call processes another person’s data, you are responsible for having a lawful basis to do so; our Privacy Policy explains how the data-protection roles are split.
7. Availability
The Service is provided on an “as is” and “as available” basis. During preview we make no uptime commitment and may change, suspend, or discontinue any part of the Service. We are not liable for calls that fail, are delayed, or are cut short.
8. Suspension and termination
- You may stop using the Service and ask us to close your account at any time.
- We may suspend or terminate access if you breach these Terms, if the law requires it, or to protect the Service or others.
- If we terminate for your breach, unused credit may be forfeited to the extent permitted by law. If we discontinue the Service or terminate without cause, we will refund your unused, unexpired credit.
9. Disclaimers and liability
- To the fullest extent permitted by law, the Service and all call outcomes are provided without warranties of any kind, including fitness for a particular purpose or that a call will achieve its objective.
- To the fullest extent permitted by law, our total liability relating to the Service is limited to the amount you paid us for credit in the 12 months before the event giving rise to the claim, and we are not liable for indirect or consequential losses or for decisions made in reliance on a call outcome.
- Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, for fraud, or your mandatory statutory rights as a consumer.
10. Indemnity
If you use the Service in a professional or business capacity, you will indemnify us against third-party claims arising from calls you initiated in breach of these Terms or of applicable law.
11. Changes to these Terms
We may update these Terms. If a change is material we will take reasonable steps to notify you, for example by email. Continued use after a change takes effect means you accept the updated Terms.
12. Governing law and disputes
These Terms are governed by the laws of [FILL IN: EU member state], and the courts of [FILL IN: competent courts — city, EU member state] have jurisdiction — in each case without prejudice to any mandatory consumer protections available to you under the law of your country of residence. If you are an EU consumer, you may also use the European Commission’s Online Dispute Resolution platform.
